Thanks for using OFF!

These Terms of Service (“Terms”) are a binding legal agreement between you and Eclipse srl that govern your use of the Off platform (“OFF”). When used in these Terms, “OFF,” “we,” “us,” or “our” refers to Eclipse srl, a digital agency with its registered office in via S. Pasquale 36, Benevento, Italy. 

The OFF platform provides a service that allows to publish and search for listings of ex display luxury furnishings.

- For Sellers, the platform offers the opportunity to publish listings to promote the sale of the products displayed in their showrooms (Sellers);
- For Users, it allows to search for ex-display furnishings and contact the related Sellers (Users).

‍Sellers are invited to read the “Seller Terms & Conditions” and make sure they understand them because their use of the OFF Service is subject to those Terms.‍

1. Role of OFF
‍As the provider of the Platform, OFF does not own, control, offer or manage any listings of Sellers. If a User chooses a product on OFF and wants to buy it, he/she has to contact the Seller. OFF is not a party to the contracts concluded directly between Users and Sellers, nor is the owner of the products displayed on the Platform. as a consequence of entering into a sale contract with the Seller, no contractual relationship is established with OFF. Off doesn’t earn any commission on the sale of products by Sellers.  

2. Prices on the listings
‍Prices are set by Sellers. They refer to the products available in the showroom and displayed on the Seller’s OFF account  “as they are”. Unless expressly specified, prices are inclusive of Italian VAT. They don't include the shipping costs. Payments will be processed by the single Seller out of the OFF platform. Off doesn’t earn any commission on the sale of products by Sellers.  

3. Listings content
‍Images, video and descriptions about the products are provided by Sellers who acknowledge and agree to a) provide accurate and detailed product descriptions, high-quality images; b) ensure that descriptions accurately represent the product's features, dimensions, and condition; c) use clear, well-lit photographs that showcase the products from multiple angles. OFF is not undertaking and assumes no responsibility, obligation or liability relating to the Content submitted by Sellers.

4. Purchase conditions
‍The contact to a Seller is a non-binding transaction representing a User's expression of interest in buying the seller's product and does not create a formal contract between the buyer and the seller. The sale of the products listed on the OFF platform will be processed by the Seller out of the OFF platform and will not establish any contractual relationship between OFF and the Buyer. In order to buy the product, the User shall enter into a legally binding contract of purchase directly with the Seller.

5. Ownership of OFF
‍Eclipse srl is the sole owner of the website OFF.design as well as of the related rights deriving from the use of the Platform.
